If you wish to import engineered fill or landscaping soils onto your property, decreasing the risk of importing contaminated material often comes at the cost of throughput.

It is an offence under the POEO Act, 1997 to receive waste at a Site that is not lawfully able to receive that waste. All soil and other material must be appropriately classified to be received at a particular site whether it is licenced or not and, unless exempt development, the placement of material must have planning consent.

It is permissible for VENM and material classified under the resource recovery exemptions to be received at a non-licenced premises, though specific assessment is required to demonstrate compliance with those definitions. Resource recovery assessments must be undertaken to an appropriate standard, and by persons with adequate qualification and ethics to avoid liability associated with importing contaminated soil.

If material is received under a sub-standard classification, where potential contamination risks have not been considered or properly assessed at the source site, there is a potential to expose the landowner to prosecution under the POEO Act. This is why it is important to carefully review all classification reports prior to importation.
